Vellore Citizens Welfare Forum v. Union of India

[1996] Supp 5 SCR 241 · Supreme Court of India · Decision date: 1996-08-28

Key issue

How should industrial activity be reconciled with environmental protection, compensation and restoration?

Facts

A public-interest petition challenged untreated tannery effluent polluting water and agricultural land in Tamil Nadu, including the Palar river area. Case number: W.P. (C) 914/1991

Holding

The precautionary principle and polluter-pays principle form part of Indian environmental law. Polluters must bear restoration costs as well as compensation for affected persons. Sustainable development requires environmental safeguards; economic importance does not confer a right to pollute. Anticipatory action is required rather than waiting for irreversible harm. The Court ordered an authority under section 3(3), compensation assessment and recovery, pollution fines and compliance-linked closure measures. Monitoring was transferred to a Madras High Court Green Bench. Single judgment by Kuldip Singh; no dissent recorded. Provisions considered at judgment date: Constitution: Articles 21, 47, 48A and 51A(g); Environment (Protection) Act 1986, section 3(3); Water Act 1974.
